What this session will cover

The session will explore the key economic sanctions regimes, and the impact of those regimes on London seated arbitrations. The panel will discuss the various ways in which sanctions issues increasingly impact both procedural and substantive aspects of the arbitral process, including tribunal constitution, the applicable law, interim relief, enforcement and settlement discussions. Particular focus will be paid to the recent decisions in Mints & Ors v PJSC National Bank Trust & Ors [2023] EWCA Civ 1132 and Litasco SA v Der Mond Oil and Gas Africa SA [2023] EWHC 2866 (Comm), and their implication for the conduct of arbitrations in England & Wales.
