What this session will cover

Amongst other aspects, the panel will address:

  • where corruption fits in the context of arbitral proceedings,
  • whether domestic court findings on corruption are relevant to the arbitral proceedings,
  • whether a fraud argument is a question of Jurisdiction, Admissibility or Merits,
  • the standard, burden and methods of proof, (v) the role of the arbitral tribunal and the local courts when dealing with fraud allegations, and
  • the challenge and enforcement of arbitral awards in this context.
