What this session will cover

The panel will discuss the recent explosion in the invocation of state immunity as a basis for depriving domestic courts (notably in the UK, but also in other jurisdictions) from exercising adjudicative and enforcement jurisdictions over foreign sovereigns.

The Panel will discuss the recent state immunity case law in the UK and elsewhere with a view to understanding not only the current explosion in state immunity cases, but the reception of this explosion in the courts, and the status of state immunity once they are resolved.  The Panel includes multiple counsel who have appeared or are appearing for claimants and sovereigns in state immunity cases in the Court of Appeal of England and Wales and the Supreme Court of the United Kingdom, as well as the Federal Court of Australia and the High Court of Australia.
