What this session will cover

An introduction to international trust litigation from a commercial perspective, looking at: issues specific to trust litigation, the trust/commercial interface, how to effectively attack trusts and deploy trust law angles, as well as issues for commercial businesses owned by trusts.

The event is aimed at those starting out in practice, those who do not specialise in private wealth disputes and/or experienced trust litigators keen to ground their expertise in a commercial context. It will focus on: what commercial litigators need to know about trusts and estates; issues that arise at the interface between trust and commercial litigation and how to handle those issues.  The panel will examine the weapons in the armoury of a trust litigator (such as freezing trust assets, Cobden-Ramsay orders, accounts for wilful default). It will consider the international perspective and the corporate angles to bear in mind where commercial business assets are ultimately owned by trusts.
