Panellists will address issues arising from allegations of fraud in a variety of contexts in arbitration involving Indian parties/ seated in India.
1. The ‘battle’ at the reference to arbitration stage, where the arbitrability of a dispute is challenged due to an allegation of fraud
2. Guerilla tactics deployed in arbitrations involving fraud
3. Carnage after 1 – where the dissatisfied party uses civil fraud as a ground to challenge an arbitral award
4. Carnage after 2 – Judicial interference with arbitral awards
5. Are English/foreign court proceedings the answer (assuming there is an English/non-Indian nexus)?
