Inter-consortium disputes on international construction projects give rise to unique challenges and dispute resolution considerations. This panel will examine critical issues in consortium arrangements and multi-party disputes.
EPC contractors on large international projects often comprise a group of companies of varying specialisms and nationalities, gathered under an unincorporated consortium umbrella. Their consortium arrangements can be thinly documented with little attention to scope split, interface and unity. Consortium deadlock can critically impact projects, derail negotiations with owners and subcontractors, and result in complex claims and disputes. Drawing on experiences, the panel will consider how to set consortiums up for success and, if disputes are inevitable, how to manage multiple and multi-party arbitrations.
