What this session will cover

This session will examine why London is, and should remain, a pre-eminent forum to meet your commercial, business and legal needs in the resolution of complex cross-border financial services disputes.

It will highlight London’s depth and quality of expertise in dispute resolution, the consistency of decision making on offer, as well as the impartiality and efficiency of the available procedures (including in fora other than the High Court). The session will involve leading representatives from industry, the senior judiciary, the legal profession and legal services specialists.

The programme will cover:

Litigating financial disputes in London: a closer look at the High Court’s Financial List; including

  • Key note speech by the Right Honourable Lord Justice Hamblen (Lord Justice of Appeal involved in the initial consultation establishing the Financial List); followed by
  • Panel discussion on litigating in the Financial List involving Susana Cao Miranda (Linklaters LLP), Rosalind Phelps QC (Fountain Court Chambers) and Sonia Tolaney QC (One Essex Court)

“The Future is Here…”: a bite-sized examination of the key upcoming trends and issues in financial services disputes and how London is placed to deal with them; including talks on:

  • Arbitration and financial services disputes – Jackie van Haersolte-van Hof (Director General, LCIA).
  • Third party funding/collective actions and the impact on financial services litigation – Jonathan Cary (RPC)
  • Smart contracts & blockchain disputes – Ian Moulding (Clifford Chance)
  • The replacement of LIBOR and cyber security litigation – Whiston Bristow (Hogan Lovells)

Financial services disputes in a post-Brexit world: including:

  • Key note speech by the Chancellor of the High Court, the Right Honourable Lord Justice Vos; followed by
  • Panel discussion reviewing how London’s financial services disputes offering is placed to respond to the challenges and opportunities of Brexit involving Jan-Jaap Baer (Travers Smith), Edward Cumming QC (XXIV Old Buildings) and Tiago Duarte-Silva (Charles River Associates.
